Noise intrusion - attention Southwark residents

Dear Southwark Council residents:

Are you or does someone you know suffer from noise intrusion coming from the flat above you/them due to laminate flooring?

We have lived under a noise nuisance for the past year because the people above us have laminate flooring and no carpeting or other insulating material to deaden their "normal" living noises. The Council has no policy in place to deal with this situation and claims that they can do nothing about this sort of noise problem.
However, the Council is mistaken. The law is on our side, but we must prove it in court.

We are aware that many others suffer from this same problem, so we are proposing a class action lawsuit against the Council in order to create a solution for all of us.

it'd probably be easier to go to the owner of the freehold, or the managing agency, as most flats have a clause in the leasehold that states that wooden floors are prohibited. Ours does, which is why we've not put wooden floors in, although several other flats in our block do have. They are breaking the T&Cs of the leasehold.

I'd go that way first before going to court against the council.

unless of course the council is the freeholder.....
in which case take them to court!

You need to check the lease. Yours will probably be the same as theirs. The convention is carpet to minimise noise nuisance.
